Welcome to Clearhaven (the “Site”), operated at clearhaven.link (“Clearhaven,” “we,” “us,” or “our”). These Terms of Service (“Terms”) form a legally binding agreement between you (“User,” “you”) and Clearhaven governing your access to and use of the Site, including our game catalog, editorial guides, rankings, comment features and any other content or functionality we offer.
1. Acceptance of These Terms
By browsing, accessing, or using clearhaven.link in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree with any provision of these Terms, you must immediately discontinue use of the Site.
Our games, guides and services are intended for a general audience and are not directed at children under 13. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” then includes that organization.
2. User Rules, Rights and Responsibilities
2.1 Permitted use. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial entertainment and information purposes, in compliance with these Terms.
2.2 Your rights. You are free to play the browser games we embed (subject to each game’s own terms), read and share links to our guides for personal use, submit comments and suggestions through our contact and comment features, and report errors or outdated guide content so we can correct them.
2.3 Your responsibilities. You agree not to:
- use the Site for any unlawful, fraudulent, harassing, hateful, or sexually exploitative purpose, or to distribute malware, spam, or deceptive content;
- post comments or messages that are abusive, defamatory, infringing, off-topic advertising, or that contain personal data of third parties;
- attempt to gain unauthorized access to the Site, its servers, or any connected systems; probe, scan, or stress-test vulnerabilities; or circumvent access controls;
- scrape, harvest, or automatically collect content, game data, or metadata from the Site at a scale that degrades performance, except through means we expressly provide (for example, standard search-engine indexing);
- mirror, frame, or re-host our guides, reviews, or editorial scores on another website without our prior written permission;
- remove, alter, or obscure proprietary notices displayed on the Site or within embedded games;
- use bots, automation, or any tool to manipulate rankings, scores, likes, or comment counts;
- impersonate Clearhaven, our editors, or any other person, or misrepresent your affiliation with us.
2.4 Enforcement. We may remove any content that violates these rules and may restrict or block access for users who violate them, in accordance with Section 9 (Termination).
3. Intellectual Property
3.1 Clearhaven-owned content. The Site’s original content — including without limitation our guides, reviews, editorial scores, rankings methodology, site design, layout, graphics, logos, text, and software — is owned by Clearhaven or our licensors and is protected by copyright, trademark, and other intellectual property laws. The Clearhaven name, the clearhaven.link domain, and related trade dress may not be used without our prior written consent.
3.2 Limited license to you. Subject to these Terms, we grant you a personal, revocable license to view and link to our editorial content. You may quote brief excerpts with clear attribution and a link to the original page; you may not republish full guides, reproduce our scores out of context, or use our content to train commercial datasets without written permission.
3.3 Third-party games. The browser games displayed on Clearhaven are owned by their respective developers and publishers. Clearhaven does not claim ownership of any third-party game, and each game remains subject to its own license terms. Our guides describe how games behave; they do not grant you any license to the games themselves.
4. User Content and Comments
If you submit comments, tips, suggestions, or other material (“User Content”), you retain ownership of your User Content. However, you grant Clearhaven a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and moderate such User Content in connection with operating and improving the Site.
You represent that your User Content is yours to submit, does not infringe any third-party rights, and complies with these Terms. You are solely responsible for your User Content. Note that comments on game pages are currently stored locally in your browser; they may not be visible to other users and may be lost when you clear browser storage. We reserve the right, but not the obligation, to moderate or remove User Content that violates these Terms.
5. Third-Party Links, Games and Services
The Site embeds games hosted by third-party platforms and links to external websites (“Third-Party Services”). Clearhaven has no control over, and assumes no responsibility for, the content, availability, privacy practices, or terms of any Third-Party Service. Your use of a third-party game or link is at your own risk, and you should review the applicable third-party terms before playing or sharing any personal information. Inclusion of a link or game does not imply endorsement.
6. Editorial Scores, Reviews and Disclaimers
6.1 Nature of our content. All scores, rankings, reviews, and guides on Clearhaven are subjective editorial opinions produced after hands-on evaluation. They are not official ratings from any game developer, publisher, or platform, and they must not be represented as such. Rankings are generated from our published methodology and may change as the catalog or scores are updated.
6.2 “As is” service. THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF GUIDES. GAME MECHANICS CHANGE WITH UPDATES; A GUIDE THAT WAS ACCURATE WHEN PUBLISHED MAY BECOME OUT OF DATE.
6.3 No professional advice. Nothing on the Site constitutes legal, financial, medical, or other professional advice.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEARHAVEN, ITS OPERATORS, EDITORS, CONTRIBUTORS, PARTNERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, GAME PROGRESS, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- your access to, use of, or inability to use the Site;
- any error, omission, or inaccuracy in any guide, score, ranking, or review;
- conduct of any third party, including third-party game providers and other users;
- unauthorized access to or alteration of your data; or
- any other matter relating to the Site.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. CLEARHAVEN IS PROVIDED FREE OF CHARGE; SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
8. Indemnification
You agree to defend, indemnify, and hold harmless Clearhaven and its operators, editors, and contributors from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property or privacy right.
9. Suspension and Termination (Accounts & Access)
9.1 No mandatory accounts. Clearhaven does not currently require user registration to browse or play. If account-based features are introduced in the future, this Section will apply to those accounts, and we will update these Terms accordingly.
9.2 Our right to restrict access. We may suspend, restrict, or terminate your access to the Site, at any time and without prior notice or liability, if we reasonably believe you have violated these Terms, abused comment or contact features, or used the Site in a way that could harm Clearhaven, other users, or third parties.
9.3 Your right to stop using the Site. You may stop using the Site at any time. Because we do not maintain user accounts today, there is no account deletion process; clearing your browser storage (including localStorage) removes any locally stored comments, likes, and favorites associated with the Site on that device. If accounts are launched later, you will be able to delete your account through the account settings or by contacting us, and we will process deletion within a reasonable period as described in our Privacy Policy.
9.4 Survival. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law — shall survive any termination of these Terms.
10. Changes to These Terms
We may revise these Terms at any time in our sole discretion. When we do, we will update the “Last updated” date at the top of this page and, for material changes, provide additional notice (for example, by a notice on the Site homepage) at least 30 days before the revised Terms take effect. Your continued use of the Site after the effective date of the revised Terms constitutes acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Site before the changes take effect.
11. Dispute Resolution
11.1 Informal resolution first. Before filing any claim against Clearhaven, you agree to try to resolve the dispute informally by contacting us at [email protected]. We will try for at least 30 days to resolve any dispute informally.
11.2 Formal proceedings. If the dispute is not resolved informally, either party may pursue formal proceedings as permitted under Section 12 (Governing Law and Jurisdiction). Where applicable law grants you the right to bring claims in your local consumer courts, nothing in these Terms limits those non-waivable rights.
12. Governing Law and Jurisdiction
12.1 Governing law. These Terms and any dispute arising out of or relating to them or the Site shall be governed by and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict-of-law principles.
12.2 Jurisdiction and venue. Subject to Section 11, you and Clearhaven agree that the exclusive venue for any dispute not resolved informally shall be the people’s courts with jurisdiction over the district where Clearhaven maintains its principal place of business in the People’s Republic of China — currently recommended venue: the Haidian District People’s Court, Beijing, People’s Republic of China. You and Clearhaven each consent to the personal jurisdiction and venue of those courts.
12.3 Users outside the PRC. If you access the Site from a jurisdiction where these provisions are unenforceable, the mandatory consumer protection laws of your country of residence continue to apply to the extent required, and the remainder of these Terms remains in effect.
13. General Provisions
13.1 Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force.
13.2 No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
13.3 Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Clearhaven regarding the Site and supersede any prior agreements on the same subject.
13.4 Assignment. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
14. Contact Us
